Missouri Executes Herbert Smulls

BONNE TERRE, Mo. -- Convicted killer Herbert Smulls was put to death by the state of Missouri early Thursday morning at the state prison in Bonne Terre.

The execution was carried out after the U.S. Supreme Court lifted a temporary stay of execution and denied last minute appeals.  Smulls, 56, was convicted of killing a Chesterfield, Missouri jewelry store owner during a robbery in 1991.

Reuters reports Smulls did not make a final statement.

Smulls' lawyers tried to block the execution, in part, by questioning the compound drug Missouri uses to carry out lethal injections.  They argued the drugs may cause undue suffering.

Smulls was the third person executed in Missouri since November.
