WASHINGTON COUNTY, Ark. -- Prosecutors say they will not file charges against a former Washington County Sheriff's deputy arrested for rape.

Fayetteville police arrested Hayden Miller in May, after a man claimed Miller sexually assaulted him in July of 2013. The man told officers it happened at Miller's home while he was sleeping, but he didn't come forward until almost a year later.

Prosecutors say now, the victim has decided he doesn't want to move forward with the case and wants to put the incident behind him. Therefore, no charges will be filed against Miller.
