Father of Abducted Marionville Girl Charged, Remains in Oklahoma Jail

OKLAHOMA COUNTY, Okla. – Andrew Smith, the non-custodial father of Danielle Smith, has been charged after abducting the girl near the Marionville Elementary School and fleeing to Oklahoma on Monday.
OKLAHOMA COUNTY, Okla. – Andrew Smith, the non-custodial father of Danielle Smith, has been charged after abducting the girl near the Marionville Elementary School and fleeing to Oklahoma on Monday.

According court documents, Smith has been charged with first-degree endangering the welfare of a child and interference with custody.

Smith’s brother, Oliver Richard Smith, is facing identical charges after assisting Andrew in taking Danielle.

According to a probable cause statement, the report of a parental abduction was called in to police around 7:45 a.m. Monday.

Police spoke with Marionville Elementary Principal Christy Short and a teacher, Jessica Franklin.

Franklin said she saw a white or gray Toyota Camry pull to the side of the road next to two juveniles who were walking to school. She said the man in the back seat began to wave his hands, like he was attempting to get the juveniles to get in the car, according to the statement.

When the kids refused to get into the car, the man grabbed the female juvenile and pulled her into the vehicle. The male juvenile walking with her then got into the vehicle.

The car drove up to the school, where Franklin says she saw the man and the male juvenile get out of the vehicle. The boy was crying, while the man hugged him, Franklin says in the statement.

Franklin says she felt something was wrong when she noticed the girl didn’t get out of the vehicle, but the boy went into the school.

Franklin contacted Short about the incident and they went in search of the boy.

According to the statement, the boy said he was the abducted girl’s brother. He said his father, Andrew, grabbed Danielle and, along with another man, refused to let her out of the car.

Later, police spoke with Danielle’s mother, who said she had full custody of the children and did not give Andrew permission to take Danielle. She said Andrew has a history of abuse against Danielle.

An investigation revealed the car Danielle was taken in was registered to Andrew’s brother, Oliver, from Texas.

Police contacted Andrew’s cell phone service provider and tracked him to Tulsa, Okla. Using the process of “pinging,” according to the statement.

The Oklahoma State Highway Patrol was contacted and informed of the Smiths’ location.

Patrol later located the car near Oklahoma City, but Oliver was the only person in the vehicle.

He was transported to the Lincoln County Jail, where he remains under a $150,000 bond.

Andrew and Danielle were later found in Oklahoma County. Andrew was arrested and transported to Oklahoma County Jail, where he remains, also under a $150,000 bond.
